TERMS AND CONDITIONS

These Terms and Conditions apply to use of this website and to any services or goods supplied by Rhiannon Piper Conservation (and, where stated, RPA Studio) (“we”, “us”, “our”). By using this website, requesting a quotation, booking services, or placing an order, you agree to these Terms.

1. Definitions

1.1 “Client” or “you” means the person or organisation requesting services or purchasing goods.

1.2 “Services” means conservation, restoration, documentation, consultation, and related work.

1.3 “Goods” means artworks, prints, products, framing/packaging materials, or any other items sold via this website or by invoice.

1.4 “Quotation” means a written estimate for Services or Goods.

1.5 “Artwork” means the item(s) submitted by you for assessment, treatment, storage, transport, or sale.

1.6 “Working days” means Monday to Friday excluding public holidays in England and Wales.

2. Website use

2.1 You may use this website for lawful purposes only.

2.2 All website content (text, images, design, branding) is owned by us or licensed to us. You may not copy, reproduce, or use it without written permission, except where permitted by law.

2.3 We may update this website and these Terms at any time. The version published here applies at the time you place an order or confirm Services.

3. Quotations, assessments, and instructions

3.1 A Quotation is an invitation to treat. A contract forms only when we confirm acceptance in writing (including by email) and, where applicable, you pay any required deposit.

3.2 Quotations are based on the information available at the time. Conservation work can reveal hidden condition issues. If assessment after receipt identifies additional or less work, we will discuss any change and provide an updated Quotation before proceeding.

3.3 Unless stated otherwise, Quotations are valid for 90 days.

3.4 You confirm that you have authority to instruct us in relation to the Artwork (for example, that you are the owner or authorised agent).

4. Conservation and restoration services

4.1 We will carry out Services with reasonable care and skill and in line with professional practice.

4.2 Conservation outcomes can involve unavoidable uncertainty due to materials, previous treatments, age, and condition. You accept that we cannot guarantee specific aesthetic results.

4.3 Where treatment options exist, we will explain the material risks and obtain your approval before proceeding.

5. Deposits, payment, and VAT

5.1 Unless agreed otherwise in writing, we may require a deposit before work begins. Deposits usually cover assessment time, testing, reserved studio time, and materials ordering.

5.2 The balance is due on completion and before collection, return shipment, or delivery, unless we agree credit terms in writing.

5.3 Late payments may incur interest at 5% above the Bank of England base rate per annum (calculated daily), plus reasonable recovery costs.

5.4 VAT will be charged where applicable and shown on your invoice.

6. Storage and uncollected items

6.1 Once an assessment report is issued or work is completed, you must arrange collection or delivery within 28 days unless agreed otherwise.

6.2 After 28 days, storage fees may apply at £20 + VAT per item per week, with higher fees possible for oversized, heavy, or high-risk items. We will notify you before applying increased rates.

6.3 If you do not respond to reasonable attempts to contact you, and the item remains uncollected for 180 days or more, we may treat it as abandoned and may dispose of it or sell it to recover unpaid fees and reasonable costs. We will make reasonable efforts to contact you before doing so and will keep records of those attempts.

7. Transport, delivery, and risk

7.1 Unless agreed otherwise, you are responsible for arranging insurance for the Artwork during transport and while in our care. If we arrange transport or storage on your behalf, this does not automatically include insurance unless stated in writing.

7.2 Delivery times are estimates. We are not liable for delays outside our control.

7.3 Risk in the Artwork remains with you except to the extent that loss or damage is caused by our proven negligence.

8. Lien (right to retain possession)

8.1 We have the right to retain the Artwork and any related materials until all sums due (including fees, materials, transport, and storage) are paid in full.

9. Liability

9.1 Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under law.

9.2 Subject to clause 9.1, our total liability to you is limited to the amount you paid for the relevant Services or Goods.

9.3 We are not liable for indirect or consequential losses (for example, loss of profit, loss of opportunity, or reputational loss).

9.4 You must notify us in writing of any issue with Services or Goods within 30 days of completion/delivery.

10. Photography and documentation

10.1 We may photograph Artwork for condition recording and documentation as part of professional practice.

10.2 We may use images of Artwork for portfolio, teaching, lectures, publications, website, and marketing unless you opt out in writing before work begins.

10.3 If confidentiality is required (for example, private collections), you must tell us in writing before the Artwork is received.

11. Shop terms (prints, artworks, and products)

11.1 Product descriptions and images are as accurate as reasonably possible, but colours may vary between screens.

11.2 Prices are shown in GBP unless stated otherwise.

11.3 We reserve the right to withdraw items, correct errors, and refuse or cancel orders (with a refund) where necessary.

12. Delivery for shop orders

12.1 Dispatch times are estimates. If an item is made to order, we will provide an estimated timescale.

12.2 Delivery costs and options are shown at checkout or on invoice.

12.3 Risk passes to you on delivery. Title (ownership) passes when payment is received in full.

13. Returns and cancellations (consumer purchases)

13.1 If you are a UK consumer buying Goods online, you may have rights under the Consumer Contracts Regulations 2013 and the Consumer Rights Act 2015.

13.2 You may cancel eligible Goods within 14 days of delivery for a refund, provided they are returned in their original condition. You are responsible for return postage unless the item is faulty.

13.3 The following are usually not eligible for change-of-mind returns: custom commissions, bespoke items, personalised items, and sealed goods once unsealed where hygiene rules apply (where relevant).

13.4 If Goods arrive damaged or faulty, contact us within 48 hours of delivery with photos of the packaging and item so we can resolve it.

14. Commissions (artwork)

14.1 Commission details (scope, size, media, timeframe, price) will be confirmed in writing.

14.2 A non-refundable deposit may be required to secure a commission slot and cover materials and time.

14.3 Minor variation is part of making original artwork. We will not replicate another artist’s work.

14.4 Unless agreed otherwise, the copyright in commissioned and sold artworks remains with the artist (Rhiannon Piper). You purchase the physical object, not the copyright.

14.5 You may not reproduce the artwork commercially (prints, merchandise, marketing) without written permission and a separate licence.

15. Intellectual property and linking

15.1 You may not use our name, images, or branding in a way that suggests endorsement without permission.

15.2 You may link to this website, provided the link is fair and legal and does not damage our reputation. We may request removal of links that mislead or misrepresent.

16. Force majeure

16.1 We are not liable for failure or delay caused by events outside reasonable control (including severe weather, fire, flood, strikes, supplier failure, courier disruption, or illness).

17. Governing law

17.1 These Terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction.

18. Copyright

18.1 The Copyright Act 1988 is effective throughout the commission process including all material distributed as part of the consultation, design review of works up to and including the final piece as such Copyright belongs to the artist Rhiannon piper/RPA Studios. Images of sold paintings may still be used by the Seller for any future use including but not limited to advertising, books and other publications, social media and other web based use.

18.2 You may not create a link to this website from another website or document without Rhiannon Piper or RPA Studio prior written consent.
